Personal estate planning is at it's most basic a Will, Enduring Power of Attorney (in its various forms depending which State/Territory you reside in) and potentially a Health Directive. Everyone over the age of 18 needs at least a base level Will and Enduring Power of Attorney. Even if you don't think you have sufficient assets, these documents are still important as they also appoint decision-makers. Everything is more expensive and complicated if you don't have a Will or Enduring Power of Attorney.
In addition to your Will and Enduring Power of Attorney, comprehensive and complete estate planning should also include a review of your superannuation, insurances, any other structures you are involved in (companies, trusts, self-managed superannuation funds for example), formal and informal loan arrangements, manner of asset ownership and the passing on of any decision-making roles you hold.
When someone passes and you find yourself in the position of needing to "get things sorted", you should be able to lean on a professional who will make the process as seamless and comfortable as possible. We can assist with all assets of estate administration from applying to the Court for a Grant of Probate of Letters of Administration, to dealing with all assets of the estate including formal establishment of trusts if included in the Will.
If you have a particular scenario or question relating to Trusts, Superannuation, Taxation or any legal matter, we would be happy to have a no-charge, no-obligation discussion with you to provide initial general guidance and then to create practical steps to deal with the issue or question in the most appropriate manner. This could result in specific legal advice, support and management of a tax office audit, advice and implementation of legal agreements and documents, or sometimes you just need a sounding board to get high-level comments on a bit of a curly question. Contact us to talk it through and we will create a plan to resolve it.
Dealing with the succession of the assets of your business, the management decision-making and the ownership and control is vital to your businesses future success. We can undertake a review of the current state of your business, its life-cycle stage, structure, people, ownership, governance and operational management and provide advice to implement a comprehensive business succession plan. This may involve managing the business succession plan within the context of the family estate plan, or may involve looking to formally include and incentivise employees to be involved in the business in the long-term. We can provide advice, support and implementation across all of these areas.
